Termination of Employment

If you resign from your employment then you are obliged to give notice.

This should be either set out in your contract of employment or as set down by statute.

In the absence of a different contractual notice period you are obliged to give at least 1 week’s notice to your employer.

If you do not believe that the termination of your employment is fair then you should take advice.  If you believe that you have been unfairly dismissed then you usually need to have been employed for 2 years to be able to begin a claim.  However in discrimination cases you do not need any length of service to begin a claim.

You may be offered a settlement agreement – you need to take independent legal advice upon that. Your employer usually pays for you to do that or contributes towards those fees.  We regularly advise employees regarding settlement agreements and take the mystery and anxiousness away regarding dealing with such matters.

Remember that you are entitled to be paid any accrued but untaken holiday entitlement when your employment comes to an end.
